Glossary of terms used in these regulations:
Entrepreneur – a legal entity conducting business activity on its own behalf, including Biroskop.
Export – selling and shipping goods outside of European Union territory.
Buyer – any entity placing an Order in the Online Store (Consumer or person without the status of a Consumer).
Consumer – a natural person making a legal transaction with the entrepreneur (including the conclusion of a sales contract) not directly related to his business or professional activity (hereinafter also referred to as the “Client”).
Complaint – procedure in the event of a defect in the goods sold.
Warranty – the mode of pursuing liability from the entrepreneur who sold the goods to the Consumer, in the event of a physical or legal defect.
Goods – an item available for sale in the Online Store. Items that can be sold within the European Union or Exported outside of it.
Significant defect – the basis for the Consumer to exercise certain rights under the warranty.
Information document – a document attached to the Good informing the Consumer about the use of the Good.
Online store – a website belonging to Biroskop in which the order was placed by the Buyer.
Order – the Buyer’s declaration of intent, aiming at concluding a remote sale of Goods via the Online Store, specifying at least the type and number of Goods.
General information
- The Regulations define the rules for concluding and performing the contract for the sale of Goods on the Online Store website. This document regulates the process of selling Goods within Polish territory as well as from Poland to other countries.
- To place Orders in the Online Store, it is necessary to have devices that allow access to the Internet, e-mail, as well as a web browser.
- The main subject of the Biroskop service is the sale of carving tools and accessories for the production of amateur and industrial ceramics.
- The content of the Online Store does not constitute an offer within the meaning of the Civil Code, and therefore placing an order by the Buyer does not mean the immediate conclusion of the contract.
- Orders placed on the website for products presented by Biroskop are only an invitation to submit purchase offers. The sales contract is concluded upon confirmation of the order by Biroskop in the form of an e-mail sent to the Buyer. Until this confirmation is received, the Buyer is entitled to cancel the order.
- Biroskop makes every effort to ensure that the photos, descriptions and technical data of the placed Goods are as realistic as possible. All photos are property of Biroskop.
- Due to the nature of the Goods – their hand-made and materials of natural origin, individual pieces will differ in details, color or weight. Their application and main function remain the same. The delivered goods may differ from the goods presented in the Online Store. However, its aesthetics and use will remain the same. All Goods are handmade products and by consequence of that they may slightly vary.
- We try to make the tools as precise as possible. Nevertheless, minor scratches or discolorations may appear on the Goods, the Buyer is aware of this when making a purchase.
- The producer of the Goods is Biroskop.

- In matters not covered by these regulations, the provisions of generally applicable law shall apply, including the Civil Code Act and the Act on Consumer Rights.
- These regulations do not exclude or limit any rights of the Buyer who is a Consumer, which he is entitled to under the mandatory provisions of law. In the event of a conflict between the provisions of these Regulations and the mandatory provisions of law granting Consumers rights, priority shall be given to these provisions.
SALE OF GOODS
GENERAL INFORMATION

- All prices of the Goods given in the Online Store are gross values, expressed in PLN or Euro (EUR) and include all taxes and public levies.
- In addition to the price of the Goods, the Consumer also covers the costs of its delivery to the address indicated in the order.
- The cost of delivery is added to the order amount.
- The cost of delivery of the Goods purchased by the Consumer depends on the method of delivery chosen by the Consumer.
- All prices in the store that are offered to be sold outside of Poland have different prices than on the Polish market. This might be forced by additional costs of taxing, accounting, document translating and potential return costs assurance.
- Biroskop accepts the following forms of payment:
- PayPal
- Visa / Mastercard Card payment
- Payment by bank transfer to the Seller’s bank account (in this case, the Consumer bears the costs of a possible bank or postal fee for executing the transfer order).
If the Consumer chooses the “bank transfer” payment option, the price of the Goods plus the cost of delivery should be paid to the Biroskop bank account:

- Biroskop accepts the following forms of payment:
specifying the order number in the title of the transfer.
EXECUTION OF THE CONTRACT
- Biroskop accepts orders electronically using the Online Store 7 days a week, 24 hours a day.
- In order to place an Order via the Online Store, add the selected Goods to the basket, and then follow the further information displayed on the Online Store website.
- The Seller is obliged to deliver the Goods ordered and purchased by the Consumer without physical and legal defects.
- The conclusion of the contract with the Buyer takes place at the moment of receiving the money transfer for the order placed by the Seller.
- The execution of the order paid by bank transfer or via the electronic payment system takes place after the conclusion of the contract and the Buyer’s payment is credited to the Seller’s account, but not later than 4 working days after the payment is credited.
- In a situation where, for objective reasons and beyond the control of Biroskop, the ordered Goods will not be in stock, the Buyer will be immediately informed of this fact and will have the option of changing the ordered Goods for another, expressing consent to a longer delivery time or the possibility of resigning from the order, which the consequence is the return of all monies paid.
- When placing an order, the Buyer should provide billing data with address and optionally another address for shipment, a contact phone number and e-mail address, which will be necessary to confirm the order.
- Providing incorrect data by the Buyer may prevent the execution of the order, and in particular providing the wrong address for the delivery of the Goods by the Buyer, may result in a delay in its delivery.
ISSUING A BILL OR INVOICE
- For each order, a personal invoice (without NIP) is issued for persons without business activity only.
- The invoice is issued and sent within 14 days of receiving the payment, to the email address provided during the purchase.
- We are not VAT taxpayers – Shop does not operate in B2B mode. If you want to cooperate B2B – contact us.
RETURN POLICY
General information:
- In any case you want to return something – first contact us to make your return smoother. Maybe we can sort the problem without returning.
- In case of returning from outside of European Union where tolls fees are added. Amount of money to be returned will be lowered by amount of fees that were issued to Seller by any of toll agencies – if present
EXCHANGE OF GOODS
- All Goods purchased in the Online Store, at the Buyer’s request, are exchanged for another within 14 days from the date of receipt of the Goods to be replaced.
- The Buyer may exchange the ordered Goods for another, sending unused and undamaged Goods in the original and undamaged packaging to the address of the Online Store, incurring the costs of returning the Goods and re-shipping them.
- The Buyer is asked to confirm in advance by e-mail whether the expected Goods are included in the Online Store’s offer. In the event of unavailability of the goods, Biroskop will make every effort to replace the goods as soon as possible. In a situation where the exchange is impossible (e.g. due to exhaustion of stocks), Biroskop will offer another available product to choose from or return the money to the indicated account.
- The time of the exchange is up to 7 business days, counting from the moment Biroskop receives the package. Within 7 days Biroskop will prepare and send return package. From this time , the delivery date depends on the delivery company. Biroskop will inform Buyer about any delays Biroskop is aware of.
- All complaints and returns must be previously consulted with Biroskop by e-mail or telephone to avoid misunderstandings and unnecessary costs. We always prefer to find the best and fair solution.
RIGHT TO WITHDRAW FROM THE CONTRACT
- The consumer has the right to withdraw from the sales contract concluded with Biroskop without giving any reason, within 14 days from the date of receipt of the Goods, i.e. taking possession of the Goods by the Consumer or taking possession of the Goods by a third party indicated by the Consumer other than the carrier, and in the case of when the Consumer places one Order covering many Goods that are delivered separately, in batches or parts, the fourteen-day period shall be counted from the moment of physical possession of the last Good, batch or part.
- To meet the fourteen-day deadline, it is enough to send an appropriate statement before its expiry.
- The Consumer’s declaration of withdrawal from the contract should be sent to the Seller’s the e-mail address: contact@biroskop.com. Please be aware that emails sometimes go to SPAM or there may be networking issues. The best way then is always to contact us via social media or by phone.
- As soon as possible, the Seller will confirm to the Consumer the e-mail address provided in the form of receipt of the declaration of withdrawal from the contract.
- The consumer is obliged to return the Goods to the Seller immediately, but not later than 14 days from the date on which he withdrew from the contract. To meet the deadline, it is enough to send back the Goods before its expiry.
- If the Consumer exercises the right to withdraw from the contract, the Consumer bears all direct costs of returning (delivering) the Goods to the Seller’s registered office.
- Biroskop refunds all payments made by the Consumer, using the same method of payment as used by the Buyer, unless the Consumer expressly agreed to a different method of return, which does not involve any costs.
- The return should be made by the Buyer by sending the Goods to the address provided to the Buyer when confirming the return by e-mail.
- The seller is obliged to return the value of the returned goods (including the price of the purchased products and the costs of their shipment to the Buyer) within 14 days of receiving the return (shipment from the Buyer).
- The store has the right to refuse to accept the return of goods in cases of returning damaged goods or delivering defective goods to the store, bearing traces of use.
- The buyer who is not a consumer does not have the right to withdraw from the contract referred to in paragraph 1, and in the scope of such sales, the rules and deadlines for withdrawing from the contract are governed by the provisions of the Civil Code.
COMPLAINTS
- All Goods purchased in the Online Store are subject to a 3 months warranty. With the reservation that some elements of the Goods, due to the specificity of use, are subject to wear during operation. Elements of the Goods that are subject to wear and tear are not subject to complaint due to wear. In these terms warranty does not cover:
- Worn blades / razors and other metal parts that has direct contact with the medium (such as clay)
- Worn parts of wood that has direct contact with medium (such as clay)
- Worn joints of moving parts of tools.
- Dissolution of impregnation layer of wood
- Warranty does cover situations when Goods (tools) have internal defects for example:
- Wooden breaks and dissection of the layers along the wood grains.
- Broken or bended screws or nuts
- Buyer who is a user of the tool is obligated to use the tools according to specifications. The end user of a tool is also obligated to use special impregnation solutions that Biroskop recommends. We highly discourage using any detergents and washing liquids while cleaning tools.
- Biroskop recommends keeping proof of purchase – e.g. receipt, bill. Biroskop also recommends direct contact via the contact details provided on the Online Store website before starting the complaint process.
- In the complaint, the Buyer should provide details of the complaint, in particular what Goods he is complaining about, when the defect was noticed, as well as the circumstances justifying the complaint and the Buyer’s demands.
- Within 14 days from the date of filing a complaint by the Consumer, Biroskop will inform Buyer of its position on the legitimacy of the claim. Normally it takes less time because we want to solve all problems in a peaceful way.
- Biroskop reserves the right to refuse to make a complaint if the Goods do not have a manufacturing defect. This situation may occur as a result of:
- Using the tool for purposes other than those indicated in the product description / instructions for use.
- Tool damage: breakage, bending, burning, melting, etc.
- Natural tool wear due to friction
- The shipment with the Goods under complaint should contain the Consumer’s statement, containing a reasonably accurate description of the defect of the Goods and the Buyer’s current return address, with a contact telephone number or e-mail address to enable direct and immediate contact with the Consumer.
- If, as a result of recognizing the complaint as justified by Biroskop, the Goods were repaired or replaced with a new one, or the submitted complaint was rejected as unfounded, Biroskop will immediately return such Goods by courier to the address provided by the Consumer, unless another form of delivery of the Goods is agreed with the Buyer.
- If Biroskop, at the Buyer’s request, has reduced the price of the advertised Goods or is to return the money (price of the Goods), then the relevant claim will be made by Biroskop, using the same method of payment as used by the Buyer, unless the Consumer expressly agreed to a different way of return, which does not involve any costs for him.
- In a situation where the complained Goods are not collected by the Buyer, Biroskop will call the Buyer in writing or possibly in another way personally agreed with Him to collect the Goods within 14 days from the date of receipt of such a request. After the ineffective expiry of this additional period, Biroskop will consider the complaint procedure to be completed.
- A complaint submitted by a Buyer who is not a Consumer, without the attached document confirming the sale, will not be considered.
Shipment
- The Goods purchased by the Consumer are delivered by a courier company chosen by Buyer while placing the order to the address indicated by the Buyer when placing the order as the delivery address.
- The price of shipment depends on the zone of parcel destination and is automatically calculated during checkout.
- The goods are sent within the first four working days from the moment of receiving the payment. The final time of the delivery depends on the delivering company and Seller will upgrade the Buyer about any delays Seller is aware of.
- Delivery of the Goods to the Consumer is payable, subject to the conditions in the “Sales of goods” section.
- By accepting the regulations and placing an order, the Buyer authorizes the Seller of the time of making order and completing the payment (one shipment per order) to carry out an order for sending the shipment by a courier company on his behalf. In connection with the above, each shipment order is carried out by the Buyer through the Seller. In other words: By accepting this document Buyer gives Seller permission to order the shipment on behalf of the Buyer.
- If the Buyer finds that the shipment is damaged, Biroskop recommends drawing up a damage report in the presence of the courier, which will contain the details of the recipient and the courier, as well as a brief description of the appearance of the Goods and informing the Seller immediately.
- Seller is not responsible for lost, damaged or delayed parcel.
- If the Buyer is placing an Export order (delivery outside of EU), Buyer accepts the fact that to the total order amount additional toll fees are added and price of shipment does not include any toll fees.
- If goods are delivered to the Destination and Buyer refuses to pay additional toll fees (those that were added by Buyers origin country toll agency) Buyer can return the goods and get the refund.
Important Export information
- Export means that Buyer places an order from outside of the European Union.
- Export means that Goods will be delivered to countries that do not belong to the European Union.
- With the Export mode additional toll fees are added and Buyer is obligated to pay them on it’s own. Meaning: Buyer covers all toll fees added by country or Buyers’ origin.
- Prices of shipment do not include any toll fees – it is only related to the Export. Within the European Union tools are not present.
- Buyer must be aware that all toll fees are covered by the Buyer. If you are not aware of your toll fees – contact your local toll agency for information.
